Job Description
Unit
Burges Salmon's Competition Unit offers clients 'extremely strong and spot-on advice' (Chambers and Partners) and is the only competition practice based outside London to be included amongst those recommended by Legal 500 in its London listings. This reflects our status amongst the top UK competition practices.
The main core unit sits within the Commercial department, and also gains support from the litigation team. The core team comprises one full-time competition partner, a senior associate and two assistants. We have a further full-time partner covering procurement and state aid advice who together with senior members of that team utilise the two competition assistants. We have further support from a litigation partner, senior associate and assistant on the litigation side.
Work
Our Competition Unit covers all areas of UK and EU competition law. These include commercial agreements, anti-competitive practices and behavioural issues in relation to 'dominant' companies, business strategies and internal compliance programmes, competition litigation and merger and joint venture clearances.
The Competition Unit's clients range from major multi-nationals and FTSE 350 companies to charitable organisations, and include both private and public sector clients. It acts for both complainants and defendants in competition investigations.
The Competition Unit has considerable experience of advising across a range of business sectors. These include: the retail sector, transport, financial services and banking, construction, sport, chemicals, IT, energy, media, defence, pharmaceuticals, food and drink production and distribution, and various agricultural sectors including the milk industry.
The Competition Unit's principal areas of practice are:
cartels and other anti-competitive agreements (including 'Dawn Raid' support)
behavioural infringements of competition law by dominant companies
competition issues raised by commercial agreements (including IP rights agreements)
market investigations by the OFT and Competition Commission
mergers and joint ventures (at both UK and EU level, including multi-jurisdictional merger filings)
competition litigation (including actions for damages for infringements of UK and EU competition law and private enforcement of competition rules)
utility regulation
competition audits and competition compliant business strategies, including the implementation and development of competition compliance programmes
state intervention in markets and trade issues (including state aid and non-discrimination issues and WTO 'anti-dumping' and other trade issues).
Examples of current cases:
Acting for the Co-operative Group in relation to the appeal of the OFT's Decision in the Tobacco case;
Acting for Cardiff Bus, defending the follow on damages claims recently issued at the CAT; and
Acting for The Cheese Company in relation to the OFT's investigation into the Dairy Retail Price Investigation.
Requirements
We look for excellent academics coupled with evidence of good quality training and EU/competition experience gained from one of the UK's leading law firms. A desire to build on our excellent client base and existing practice will be important as is a proven ability to win new business and a following, depending on qualification.
A candidate with regulatory or economic experience would be ideal.
