Two solicitors charged over £50m of mortgage frauds

Two solicitors have been charged with multiple offences related to a series of high-value commercial mortgage frauds worth around £50m in total.

Mark Knights of Cheshire, 45, who worked at Manchester firm Mace & Jones at the time the frauds took place, appeared last Friday at the City of London Magistrates Court alongside Kamran Malik, 31, of Birmingham, who worked at Birmingham firm A&H Solicitors at the time of the frauds.

Neither defendant is currently employed by Mace & Jones or A&H Solicitors.

Both were charged with three counts of obtaining a money transfer by deception contrary to the Theft Act 1968. The proceedings will be transferred to Southwark Crown Court.

Malik’s solicitor Julian Linskill, senior partner of Liverpool firm Linskills, said that Malik will contest the charges.

He said: ‘While he has clearly been guilty of relatively minor breaches of regulations, that does not support any finding of criminality against him. He is confident he will be cleared of the allegations.’

Manchester firm Pannone, which is advising Knights, declined to comment.

The charges against the pair were brought as part of an ongoing Serious Fraud Office investigation into the £50m of frauds, which saw six others, including four solicitors, charged in December 2009.

Freshfields unfreezes associate lockstep as firm unveils 2010 rates

Freshfields Bruckhaus Deringer has become the first leading UK law firm to announce its associate salary rates for 2010, with the magic circle firm lifting the freeze on associate lockstep put in place last year.

The firm, which also led the market last year when it froze both pay band levels and lawyers’ progression through the bands, told staff today (25 February) that the freeze would be lifted at the start of the new financial year.

Freshfields’ decision means that from May associates will move through the pay bands as normal – although the pay bands themselves will not be increased.

The newly-qualified rate, which was reduced last year, will remain at £59,000, while a one-year qualified lawyer will take home £66,000, a lawyer with two years’ experience will pocket £73,000 and a three-year qualified lawyer £86,000.

As statement from the firm said: “We have decided that there will not be a salary freeze for the coming financial year. While the outlook globally is still uncertain, our people have worked very hard to help our clients and the firm through the challenges of the last year or so, and we are grateful for the contribution everyone has made.”

Freshfields was one of a number of leading firms to freeze associate pay last year, with magic circle rival Linklaters bucking the trend and awarding its associates a marginal pay rise. The firm allowed its fee earners to progress through the lockstep as normal, however it cut the level of all of its pay bands – leaving associates with a pay rise of between 2% and 4%.

Legal Practise Courses

The Legal Practice Course (LPC) – also known as the Postgraduate Diploma in Legal Practice – is the vocational stage for becoming a solicitor in England and Wales. The course is the successor to Law Society Finals and is more vocational in its syllabus. The LPC can be taken in many different formats including full-time and part-time, on week days, evenings, and weekends. 7,076 students enrolled on the full-time LPC in September 2004, and 1,728 on the part-time course. The full-time course lasts a year, and fees range from £6,000-£12,500. A small proportion of students may have their fees and some living expenses paid for by future employers under a training contract.

The course is usually taken after a law degree, but a large minority take the course after studying a different subject at university and taking a conversion course called the Graduate Diploma in Law (GDL/CPE). The LPC is regulated through the Law Society of England and Wales. Like the GDL/CPE, the LPC can be applied to through the Central Applications Board.

Leeds Law Society

Leeds Law Society (one of the oldest local law societies in the UK) was founded in 1805 for “the protection and advancement of the character status and interests of attorneys and solicitors practising within four miles of the Borough of Leeds”. For the first 70 years of its existence the Society had no home of its own, so meetings took place in local hotels. Business meetings were followed by dinner with latecomers fined 2s 6d as a penalty for being late!

The Society was incorporated in 1870 and at that time still had only 33 members. From 1876 to 1920 the Society rented business premises in Albion Place. When the lease of those premises expired the then committee took the bold decision to purchase the adjoining building at 1 Albion Place, for the princely sum of £8,750! That building has remained home to the Leeds Law Society ever since. (more…)
